Mother Files Suit After Teachers Allegedly Play Prank On Son

Why would a Teacher (adult) humiliate an 11 year old student??? I don't know that I believe this action warrants a law suit, however, I would be mighty ticked off and need more than sympathy and alleged tears... There should have been disciplinary action taken against the Teacher.


WCPO Reports:
MILFORD, Ohio -- A federal lawsuit was filed Monday in United States District Court by attorney Eric Deters for the parent of a sixth grade student, Amanda Anoai.

The suit alleges Anoai’s 11-year-old son was teased and taunted by his language arts teacher at Milford Exempted Village School District's Boyd E. Smith Elementary School.

Anoai said her son is good at heart.

"A lot of people say he has like an old soul,” she said. “He's good to the kids that are less fortunate, [the ones that] maybe not the popular kids."

The suit claims that while Anoai's son was out of the language arts class, his teacher and teacher's aide announced to the room that a prank was going to be played on the boy when he returned.

Allegedly, the teacher's aide grabbed the back of the boy’s hair and acted as if she would cut it – and then Anoai claims – the teacher placed the boys hair in three pony tails and paraded him around the school, introducing him as a new female student.

Anoai met with school officials to discuss the supposed incident.

"I had a meeting with the principal and superintendent. They were very understanding, they were definitely sympathetic, and teary eyed, and questioning what did I want to be done,” she said. “And of course, I said they shouldn't work there any more."

The suit was filed in federal court because it is believed that the school district receives federal funds, and the boy’s rights were violated by subjecting him to discrimination under an educational program receiving federal assistance, on the basis of gender.

Some of the other allegations include: intentional infliction of emotional distress, negligence, assault, and battery.

Anoai filed the lawsuit because she believes no disciplinary action was taken against the teacher or teacher’s aide.

She, however, has been encouraging her son. "I've told him before, because of course he's been teased about his hair in the past – by children! – I told him in the past, ‘Hold your head high if you like your hair, you like your hair.’"
