Judge Dismisses Monroe Clean Air Law suit.

From Phil Callahan, City Law Director

"It is important to note that Judge Dlott did not rule on the merits of our case. In other words, the Court did not find that Monroe's analysis and position is incorrect. Essentially, this decision holds that the Federal Court will not jump into the fray so long as the ERAC appeal is pending with the State of Ohio."

Why did all this transpire on the same day that ERAC canceled the hearing in February? From what I understand we will have one hour to present our case to ERAC. What if Judge Dlott would of known of the situation in ERAC? That the City of Monroe was NOT going to get the normal routine up at ERAC? Just food for thought!
